Current industry concerns:
- Proprietary security issues/ closing loop holes
- Proprietary service providers are not required to hold NM PPO licenses. Education on security personal vs employer liability is minimal
- Use of Force issues (Vicarious Liability and Deliberate indifference) (e.g. Target 2016, Nordstrom 2017)
- NMRLD has no Compliance Division with which to enforce standard
- RLD cannot enforce statute due to lack of manning and funding
- Companies know this and take advantage of lack of monitoring
- Continued manning issues within RLD causing delay in guard licensing
- Companies continue to work without proper documentation
- Trainers teaching all levels in one day (e.g. 43 hours in 8 hours)
Current issues with regard to security companies/employees
- AAA, 2015 – SF municipal contracts. Unqualified level 3 at SF airport carrying a gun; company not paying taxes
- ISP, 2016 – Unlicensed guard killed on post
- Strider Security, 2017 – Not paying employees on time
- Unlicensed companies underbidding legitimate companies
- Security guard companies taking advantage of NM business due to lack of public knowledge regarding RLD standards
- Bullying security guards into working over-time. Threatening with termination
